Fired social workers challenging dismissal in Court

THREE employees in Ministry of Labour, Human Services and Social Security, who were fired in the midst of investigations into the controversial pension books scam, are challenging their dismissal in Court.

Brian Belgrave, Keith Sealey and Glendon Fogenay have filed an action in the Supreme Court Registry, citing the Attorney General and Mitra Devi Ali, in her personal capacity and that of Permanent Secretary in the Ministry.

The case was called before Justice Dawn Gregory-Barnes in the Bail Court yesterday and the Attorney General’s Chambers was given 21 days leave to file an answer.

Through their lawyer, Mr Benjamin Gibson, the plaintiffs are contending that their purported removal from office by the Permanent Secretary is unconstitutional, wrong in law, null and void.

The fired officials are also seeking reinstatement and payment of salary and allowances.

In a supporting affidavit, Sealey said they were employed by the Public Service Commission (PSC), at Lot 1 Water and Cornhill Streets, Georgetown, but were all summarily removed from the Public Service last November 29, by a directive from Ali who purports to hold the Office of Permanent Secretary.

They said an allegation, not detailed nor particularized, has been made against them.

Further hearing has been fixed for February 6.
