WORKING People's Alliance (WPA) executive member Eusi Kwayana has moved to have a murder charge reinstated against policeman Ryon Gomes.
The Director of Public Prosecutions (DPP) discontinued the previous proceedings but Kwayana has made an application for an order of certiorari to quash that decision.
Justice Claudette La Bennett, before whom the matter was called yesterday, gave the Attorney General more time to file an affidavit in answer.
Kwayana, of Buxton, East Coast Demerara, alleged that Gomes shot Shawn Nedd dead on February 7, 2000, in the presence of other members of the public and Police officers.
The applicant said the private criminal charge was being heard by Magistrate Dawn Holder-Alert, who had adjourned it to June 30, 2000, when the DPP intervened.
Kwayana wants the judge to grant an order of mandamus, directing the same or another magistrate to hold the preliminary inquiry into the charge.
Justice La Bennett scheduled the next hearing for April 8.
