Judge orders Lewis to table report on Donna McKinnon's death for inquest

Justice Claudette La Bennett yesterday granted an Order Rule Nisi of Mandamus directing Commissioner of Police, Laurie Lewis to forward a report on the death of Donna McKinnon, who was gunned down on April 9 outside of Freedom House, to be made to the Chief Magistrate in accordance with Section 5 of the Coroner's Act Cap 4:03.

Justice La Bennett made the order after a daughter of McKinnon's, Soffina Solomon, moved to the court through her lawyer, attorney-at-law Basil Williams, via a notice of motion seeking the order.

The judge further directed the Chief Magistrate, Paul Fung-A-Fat, to hold an inquest into the cause of the woman's death on receipt of the report in keeping with Section 6 of the Coroners Act Cap. 403.

It was further ordered that sealed and certified copies of the order and the motion with the supporting affidavit be served on Commissioner Lewis and the Chief Magistrate Fung-A-Fat within seven days from yesterday. They are also ordered to file affidavits in answer seven days after the order is served on them and Lewis is also ordered to file a certified copy of the aforementioned report within seven days after the order is served.

The matter would be heard again on June 29.

In her supporting affidavit Solomon stated that her mother died as result of haemorrhage and shock, perforation of the lung and heart, and gunshot injuries according to the death certificate. No one was held for McKinnon's death and the police have not come up with any leads.
