Judge again defers decision on Benschop bail application

JUSTICE Jainarayan Singh yesterday again deferred his decision on the application to grant treason accused Mark Besnchop bail.

The judge had previously announced that he would deliver his ruling yesterday but said the postponement is because he has not yet gone through all the submissions made by lawyers on both sides in the case.

Justice Singh said he would rule this morning.

Attorney-at-law Mr Basil Williams, representing the remanded prisoner’s wife, Maria Benschop, is contending that the judge has the discretion but Mr Sanjeev Datadin, who opposed the petition, maintained that the law precludes persons charged with that capital offence from applying to the High Court in instances where a magistrate does not have the authority.

Benschop is jointly charged with fugitive from justice Phillip Bynoe for conspiring to overthrow the lawfully elected Government of Guyana.

The preliminary inquiry into the charge is nearing end with Benschop alone in the dock and Magistrate Chandra Sohan, who is conducting the pre-trial proceedings, is to make known the outcome next Wednesday.
