The matter was fixed for February 19 after it was called at Sparendaam Court on February 4, giving the Prosecution time to supply statements.
However, the hearing was put off to yesterday, because Magistrate Stephney was absent on the previous occasion.
But yesterday, when Police Sergeant Wallace Nurse blamed a Thursday night electricity power outage for being unable to start, Magistrate Stephney threatened to dismiss the case if the situation remains unchanged on the next Court date.
Shaheed Khan was not present in Court and his lawyer, Mr. Glen Hanoman apologised for his absence but Mr. Vic Puran, for the other defendants, expressed annoyance at what he called the “unnecessary delays”.
He said Haroon Yahya and policeman Sean Belfield want the case to be dealt with expeditiously because of the stigma attached to it.
Puran also reported that the lives of the trio are being threatened, as public thinking is that they are “part of some criminal gang”.
The Defence Counsel was also critical of out of Court discussions surrounding the men whom a Guyana Defence Force Patrol arrested in a bullet proof motor vehicle in December 2002, allegedly with a large quantity of arms and ammunition, at Good Hope, East Coast Demerara.
